Accountability is a cornerstone of the governance of artificial intelligence (AI). However, it is often defined too imprecisely because its multifaceted nature and the sociotechnical structure of AI systems imply a variety of values, practices, and measures to which accountability in AI can refer. We address this lack of clarity by defining accountability in terms of answerability, identifying three conditions of possibility (authority recognition, interrogation, and limitation of power), and an architecture of seven features (context, range, agent, forum, standards, process, (...) and implications). We analyse this architecture through four accountability goals (compliance, report, oversight, and enforcement). We argue that these goals are often complementary and that policy-makers emphasise or prioritise some over others depending on the proactive or reactive use of accountability and the missions of AI governance. The EU Artificial Intelligence Act (AIA) defines four risk categories for AI systems: unacceptable, high, limited, and minimal. However, it lacks a clear methodology for the assessment of these risks in concrete situations. Risks are broadly categorized based on the application areas of AI systems and ambiguous risk factors. This paper suggests a methodology for assessing AI risk magnitudes, focusing on the construction of real-world risk scenarios. To this scope, we propose to integrate the AIA with a framework developed by (...) the Intergovernmental Panel on Climate Change (IPCC) reports and related literature. This approach enables a nuanced analysis of AI risk by exploring the interplay between (a) risk determinants, (b) individual drivers of determinants, and (c) multiple risk types. We further refine the proposed methodology by applying a proportionality test to balance the competing values involved in AI risk assessment. Finally, we present three uses of this approach under the AIA: to implement the Regulation, to assess the significance of risks, and to develop internal risk management systems for AI deployers. The advent of Generative AI, particularly through Large Language Models (LLMs) like ChatGPT and its successors, marks a paradigm shift in the AI landscape. Advanced LLMs exhibit multimodality, handling diverse data formats, thereby broadening their application scope. However, the complexity and emergent autonomy of these models introduce challenges in predictability and legal compliance. This paper analyses the legal and regulatory implications of Generative AI and LLMs in the European Union context, focusing on liability, privacy, intellectual property, and cybersecurity. It examines (...) the adequacy of the existing and proposed EU legislation, including the Artificial Intelligence Act (AIA), in addressing the challenges posed by Generative AI in general and LLMs in particular. The paper identifies potential gaps and shortcomings in the EU legislative framework and proposes recommendations to ensure the safe and compliant deployment of generative models. (shrink)

The article argues that AI can enhance the measurement and implementation of democratic processes within political parties, known as Intra-Party Democracy (IPD). It identifies the limitations of traditional methods for measuring IPD, which often rely on formal parameters, self-reported data, and tools like surveys. Such limitations lead to the collection of partial data, rare updates, and significant demands on resources. To address these issues, the article suggests that specific data management and Machine Learning (ML) techniques, such as natural language processing (...) and sentiment analysis, can improve the measurement (ML about) and practice (ML for) of IPD. The article concludes by considering some of the principal risks of ML for IPD, including concerns over data privacy, the potential for manipulation, and the dangers of overreliance on technology. Although we may find the concept of anomie in Greek thought, it is since Durkheim that the concept begins to be used specifically as a sociological concept. However, a theory of anomie only becomes consolidated since “Social Structure and Anomie” by Robert K. Merton (Merton 1938). The theory becomes important and conquers its space in the rest of the century as one of the most productive theories about deviance. In this study, based on a contemporary conception of scientific theory, that (...) of the structuralist metatheory, a reconstruction of Merton’s approach is proposed, allowing to make explicit the deep structure of the theory. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' Cancel culture is a form of societal self-defense that becomes prominent particularly during periods of substantial moral upheaval. It can lead to the polarization of incompatible viewpoints if it is indiscriminately demonized. In this brief editorial letter, I consider framing cancel culture as an essentially contested concept (ECC), according to the theory of Walter B. Gallie, with the aim of establishing a groundwork for a more productive discourse on it. In particular, I propose that intermediate agreements and principles of reasonableness (...) can help refocus the debate on cancel culture towards democratic discourse, without blanket justification for every instance. In this context, asserting that cancel culture is an ECC does not dismiss the potential of achieving consensus on its shared core meaning or societal role. Like other similar ECCs, such as democracy or rule of law, it highlights the importance of contestations in shaping our collective understanding of the concept. (shrink)

We put forward a new, ‘coherentist’ account of quantum entanglement, according to which entangled systems are characterized by symmetric relations of ontological dependence among the component particles. We compare this coherentist viewpoint with the two most popular alternatives currently on offer—structuralism and holism—and argue that it is essentially different from, and preferable to, both. In the course of this article, we point out how coherentism might be extended beyond the case of entanglement and further articulated.

This article considers distinct ways of understanding the world, referred to in psychology as Functions of Consciousness or as Cognitive Modes, having as the scope of interest epistemology and natural sciences. Inspired by C.G. Jung's Simile of the Spectrum, we consider three basic cognitive modes associated to: (R) embodied instinct, experience, and action; (G) reality perception and learning; and (B) concept abstraction, rational thinking, and language. RGB stand for the primary colors: red, green, and blue. Accordingly, a conceptual map between (...) cognitive modes and primary and secondary colors is built based on the physics and physiology of color perception and epistemological characteristics of the aforementioned cognitive modes, leading to logical relations structured as an Hexagon of Opposition. Finally, this model of cognitive modes is applied to the analysis and interpretation of some important episodes in the historical development of physics and technology. (shrink)

Penelope Maddy has recently addressed the set-theoretic multiverse, and expressed reservations on its status and merits ([Maddy, 2017]). The purpose of the paper is to examine her concerns, by using the interpretative framework of set-theoretic naturalism. I first distinguish three main forms of 'multiversism', and then I proceed to analyse Maddy's concerns. Among other things, I take into account salient aspects of multiverse-related mathematics , in particular, research programmes in set theory for which the use of the multiverse seems to (...) be crucial, and show how one may provide responses to Maddy's concerns based on a careful analysis of 'multiverse practice'. This paper has three main objectives: (a) Discuss the formal analogy between some important symmetry-invariance arguments used in physics, probability and statistics. Specifically, we will focus on Noether’s theorem in physics, the maximum entropy principle in probability theory, and de Finetti-type theorems in Bayesian statistics; (b) Discuss the epistemological and ontological implications of these theorems, as they are interpreted in physics and statistics. Specifically, we will focus on the positivist (in physics) or subjective (in statistics) interpretations vs. objective interpretations that (...) are suggested by symmetry and invariance arguments; (c) Introduce the cognitive constructivism epistemological framework as a solution that overcomes the realism-subjectivism dilemma and its pitfalls. The work of the physicist and philosopher Max Born will be particularly important in our discussion. (shrink)

Although logical consistency is desirable in scientific research, standard statistical hypothesis tests are typically logically inconsistent. To address this issue, previous work introduced agnostic hypothesis tests and proved that they can be logically consistent while retaining statistical optimality properties. This article characterizes the credal modalities in agnostic hypothesis tests and uses the hexagon of oppositions to explain the logical relations between these modalities. Geometric solids that are composed of hexagons of oppositions illustrate the conditions for these modalities to be logically (...) consistent. Prisms composed of hexagons of oppositions show how the credal modalities obtained from two agnostic tests vary according to their threshold values. Nested hexagons of oppositions summarize logical relations between the credal modalities in these tests and prove new relations. (shrink)

The main goal of this article is to use the epistemological framework of a specific version of Cognitive Constructivism to address Piaget’s central problem of knowledge construction, namely, the re-equilibration of cognitive structures. The distinctive objective character of this constructivist framework is supported by formal inference methods of Bayesian statistics, and is based on Heinz von Foerster’s fundamental metaphor of objects as tokens for eigen-solutions. This epistemological perspective is illustrated using some episodes in the history of chemistry concerning the definition (...) or identification of chemical elements. Some of von Foerster’s epistemological imperatives provide general guidelines of development and argumentation. (shrink)

This article discusses some continuous limit cases of Susan Haack’s crossword puzzle metaphor for the coherent development and foundation of science. The main objective of this discussion is to build a bridge between Haack’s foundherentism and the epistemological framework of objective cognitive constructivism, including its key metaphor of objects as tokens for eigen-solutions. The historical development of chemical affinity tables is used to illustrate our arguments.

One might suppose that Everettian quantum mechanics (EQM) is inhospitable to metaphysial indeterminacy (MI), given that, as A. Wilson (2020) puts it, "the central idea of EQM is to replace indeterminacy with multiplicity" (77). But as Wilson goes on to suggest, the popular decoherence-based understanding of EQM (henceforth: DEQM) appears to admit of indeterminacy in both world number and world nature, where the latter indeterminacy---our focus here---is plausibly metaphysical. After a brief presentation of DEQM (S1), we bolster the case for (...) there being MI in world nature in DEQM (S2). The remainder of the paper is devoted to a comparative assessment of the two main approaches to MI for purposes of accommodating this MI---namely, a metaphysical supervaluationist approach (as per Barnes and Williams 2011) and a determinable-based approach (as per Wilson 2013 and Calosi and Wilson 2018 and 2021). We briefly describe each approach (S3), then offer arguments in favour of a determinable-based approach to world nature MI in DEQM (S4). (shrink)

In this paper epistemological, ontological and sociological questions concerning the statistical significance of sharp hypotheses in scientific research are investigated within the framework provided by Cognitive Constructivism and the FBST (Full Bayesian Significance Test). The constructivist framework is contrasted with the traditional epistemological settings for orthodox Bayesian and frequentist statistics provided by Decision Theory and Falsificationism.

This article explores the metaphor of Science as provider of sharp images of our environment, using the epistemological framework of Objective Cognitive Constructivism. These sharp images are conveyed by precise scientific hypotheses that, in turn, are encoded by mathematical equations. Furthermore, this article describes how such knowledge is pro-duced by a cyclic and recursive development, perfection and reinforcement process, leading to the emergence of eigen-solutions characterized by the four essential properties of precision, stability, separability and composability. Finally, this article discusses (...) the role played by ontology and metaphysics in the scientific production process, and in which sense the resulting knowledge can be considered objective. In this article, we discuss some issues concerning magical thinking—forms of thought and association mechanisms characteristic of early stages of mental development. We also examine good reasons for having an ambivalent attitude concerning the later permanence in life of these archaic forms of association, and the coexistence of such intuitive but informal thinking with logical and rigorous reasoning. At the one hand, magical thinking seems to serve the creative mind, working as a natural vehicle for new ideas and innovative insights, (...) and giving form to heuristic arguments. At the other hand, it is inherently difficult to control, lacking effective mechanisms needed for rigorous manipulation. Our discussion is illustrated with many examples from the Hebrew Bible, and some final examples from modern science. (shrink)

This article explores some open questions related to the problem of verification of theories in the context of empirical sciences by contrasting three epistemological frameworks. Each of these epistemological frameworks is based on a corresponding central metaphor, namely: (a) Neo-empiricism and the gambling metaphor; (b) Popperian falsificationism and the scientific tribunal metaphor; (c) Cognitive constructivism and the object as eigen-solution metaphor. Each of one of these epistemological frameworks has also historically co-evolved with a certain statistical theory and method for testing (...) scientific hypotheses, respectively: (a) Decision theoretic Bayesian statistics and Bayes factors; (b) Frequentist statistics and p-values; (c) Constructive Bayesian statistics and e-values. This article examines with special care the Zero Probability Paradox (ZPP), related to the verification of sharp or precise hypotheses. Finally, this article makes some remarks on Lakatos’ view of mathematics as a quasi-empirical science. (shrink)

Fragmentalism was originally introduced as a new A-theory of time. It was further refined and discussed, and different developments of the original insight have been proposed. In a celebrated paper, Jonathan Simon contends that fragmentalism delivers a new realist account of the quantum state—which he calls conservative realism—according to which: the quantum state is a complete description of a physical system, the quantum state is grounded in its terms, and the superposition terms are themselves grounded in local goings-on about the (...) system in question. We will argue that fragmentalism, at least along the lines proposed by Simon, does not offer a new, satisfactory realistic account of the quantum state. This raises the question about whether there are some other viable forms of quantum fragmentalism. (shrink)

Simultaneous hypothesis tests can fail to provide results that meet logical requirements. For example, if A and B are two statements such that A implies B, there exist tests that, based on the same data, reject B but not A. Such outcomes are generally inconvenient to statisticians (who want to communicate the results to practitioners in a simple fashion) and non-statisticians (confused by conflicting pieces of information). Based on this inconvenience, one might want to use tests that satisfy logical requirements. (...) However, Izbicki and Esteves shows that the only tests that are in accordance with three logical requirements (monotonicity, invertibility and consonance) are trivial tests based on point estimation, which generally lack statistical optimality. As a possible solution to this dilemma, this paper adapts the above logical requirements to agnostic tests, in which one can accept, reject or remain agnostic with respect to a given hypothesis. Each of the logical requirements is characterized in terms of a Bayesian decision theoretic perspective. Contrary to the results obtained for regular hypothesis tests, there exist agnostic tests that satisfy all logical requirements and also perform well statistically. In particular, agnostic tests that fulfill all logical requirements are characterized as region estimator-based tests. Examples of such tests are provided. (shrink)

This paper investigates some classical oppositional categories, like synthetic vs. analytic, posterior vs. prior, imagination vs. grammar, metaphor vs. hermeneutics, metaphysics vs. observation, innovation vs. routine, and image vs. sound, and the role they play in epistemology and philosophy of science. The epistemological framework of objective cognitive constructivism is of special interest in these investigations. Oppositional relations are formally represented using algebraic lattice structures like the cube and the hexagon of opposition, with applications in the contexts of modern color theory, (...) The full Bayesian signi/cance test (FBST) for precise hypotheses is presented, with some illustrative applications. In the FBST we compute the evidence against the precise hypothesis. We discuss some of the theoretical properties of the FBST, and provide an invariant formulation for coordinate transformations, provided a reference density has been established. This evidence is the probability of the highest relative surprise set, “tangential” to the sub-manifold (of the parameter space) that defines the null hypothesis.

Abstract: In the present work we have made a critical review of the philosophical propo­ sal of Norwood R. Hanson with the aim of exposing the limits of its theoretical approach on the problem of interpretation in science. The first part of this work exposes the hansonian project, looking for evidence of his contributions to the philosophy of science and scientific thinking. In the following two sections we present a critique to his philosophical proposal. We present two exercises of philosophical (...) reflection that constitute two complementary moments of analysis. On one hand, at the level of methodological analysis, we present a discussion about how the “reversible perspective figures” that have been used for the author as arguments to explain his philosophical proposal, are insufficient to the descrip­ tion of the process of observation and interpretation. On the other hand, at the theoretical level, we question his notion of language and categories to show that his theoretical pro­ posed “vision-interpretation” has based on epistemological and analytic notions. From this perspective, it will be shown that the “hermeneutical-interpretative” approach of Hanson is incomplete, since it does not develop towards an ontology of language and observation. (shrink)

Heinz Von Forester characterizes the objects “known” by an autopoietic system as eigen-solutions, that is, as discrete, separable, stable and composable states of the interaction of the system with its environment. Previous articles have presented the FBST, Full Bayesian Significance Test, as a mathematical formalism specifically designed to access the support for sharp statistical hypotheses, and have shown that these hypotheses correspond, from a constructivist perspective, to systemic eigen-solutions in the practice of science. In this article several issues related to (...) the role played by language in the emergence of eigen-solutions are analyzed. Decoupling is a general principle that allows us to separate simple components in a complex system. In statistics, decoupling is often expressed as independence, no association, or zero covariance relations. These relations are sharp statistical hypotheses, that can be tested using the FBST - Full Bayesian Significance Test. Decoupling relations can also be introduced by some techniques of Design of Statistical Experiments, DSEs, like randomization. This article discusses the concepts of decoupling, randomization and sparsely connected statistical models in the epistemological (...) framework of cognitive constructivism. (shrink)

The principle of the common cause claims that if an improbable coincidence has occurred, there must exist a common cause. This is generally taken to mean that positive correlations between non-causally related events should disappear when conditioning on the action of some underlying common cause. The extended interpretation of the principle, by contrast, urges that common causes should be called for in order to explain positive deviations between the estimated correlation of two events and the expected value of their correlation. (...) The aim of this paper is to provide the extended reading of the principle with a general probabilistic model, capturing the simultaneous action of a system of multiple common causes. To this end, two distinct models are elaborated, and the necessary and sufficient conditions for their existence are determined. (shrink)

Gödel’s philosophical conceptions bear striking similarities to Cantor’s. Although there is no conclusive evidence that Gödel deliberately used or adhered to Cantor’s views, one can successfully reconstruct and see his “Cantorianism” at work in many parts of his thought. In this paper, I aim to describe the most prominent conceptual intersections between Cantor’s and Gödel’s thought, particularly on such matters as the nature and existence of mathematical entities (sets), concepts, Platonism, the Absolute Infinite, the progress and inexhaustibility of mathematics.

This paper introduces pragmatic hypotheses and relates this concept to the spiral of scientific evolution. Previous works determined a characterization of logically consistent statistical hypothesis tests and showed that the modal operators obtained from this test can be represented in the hexagon of oppositions. However, despite the importance of precise hypothesis in science, they cannot be accepted by logically consistent tests. Here, we show that this dilemma can be overcome by the use of pragmatic versions of precise hypotheses. These pragmatic (...) versions allow a level of imprecision in the hypothesis that is small relative to other experimental conditions. The introduction of pragmatic hypotheses allows the evolution of scientific theories based on statistical hypothesis testing to be interpreted using the narratological structure of hexagonal spirals, as defined by Pierre Gallais. Abstract This essay seeks to realize the following question: what is the correspondence between the sign and the thing that names? In reality, what is significant is closely linked with the being, however in this case the sense will be a particular manifestation of an own subjectivity; therefore the determinant relation is limited to the capacity of representation, where the meaning is connected with the socio-cultural sense. In this regard, this work seek realize this problem from the analytical approach of (...) Ludwig Wittgenstein, who is based on the method of philosophical investigation through formal logic. In this first period of development, his speculative work, which in principle leads to the search for logical foundations for mathematics, practised it in direction to the study of the nature of the representation. Subsequently, and as necessary this test delimitation, will expose the confrontation —more not necessarily contradiction— of their approaches in the light of the own Wittgenstein who, in a second reflective period poured into his later work, is obliged to discuss the foundational in his speculative work logical-philosophical topics from a pragmatic point of view. Abstract This paper seeks to give an account of the semiotic and interpretive processes involved in the ambiguity of media representations and, in particular, of new and of different forms of construccion-difusion of information. For this reason, it is deemed the massive dissemination of information and journalistic exercis as a semiotic process in the construction of a fictitious reality. In this regard, it i sought to account for the media representation, as the contrast of the uniform character of the mass (...) expression (context of production) and the diversity of interpretations (context of reception). This review examines both component which are the concrete support that allows the individual to mean social conten non-, mid-, and intentional, thereby fostering a strong sense of social belonging. In this paper, the notion of degree of inconsistency is introduced as a tool to evaluate the sensitivity of the Full Bayesian Significance Test (FBST) value of evidence with respect to changes in the prior or reference density. For that, both the definition of the FBST, a possibilistic approach to hypothesis testing based on Bayesian probability procedures, and the use of bilattice structures, as introduced by Ginsberg and Fitting, in paraconsistent logics, are reviewed. The computational and theoretical advantages of using (...) the proposed degree of inconsistency based sensitivity evaluation as an alternative to traditional statistical power analysis is also discussed. This paper seeks to establish the reflexive fundamentals about the importance of language in initiave-functional college education, with the general objective of finding and developing categories that allow synthesizing schemes of different approaches to language, in order to contribute to the teaching practice with discourse analysis -/- techniques, which favor processes that promote the pupils’operative intellectual habits. To present this, we will show some propositions that underlie didactic strategies we have used, to motivate, stimulate, and provoke participation from the students (...) in the teaching-learning process of the topics raised in the different subjects that integrate the Sciences of Communication course at the National Autonomous University of Mexico (UNAM). -/- Therefore, the aim of this exposition of causes is to define: 1) our experiential context so to make explicit the limitations and challenges we experiment with and face in this academic exercise to provoke the pupils’ amazement or at least keep their interest; and 2) the theoretical assumptions that underlie our investigation about the relationship between observed language (system) and lived language (act). A new Evidence Test is applied to the problem of testing whether two Poisson random variables are dependent. The dependence structure is that of Holgate’s bivariate distribution. These bivariate distribution depends on three parameters, 0 < theta_1, theta_2 < infty, and 0 < theta_3 < min(theta_1, theta_2). The Evidence Test was originally developed as a Bayesian test, but in the present paper it is compared to the best known test of the hypothesis of independence in a frequentist framework. This article presents a simple derivation of optimization models for reaction networks leading to a generalized form of the mass-action law, and compares the formal structure of Minimum Information Divergence, Quadratic Programming and Kirchhoff type network models. These optimization models are used in related articles to develop and illustrate the operation of ontology alignment algorithms and to discuss closely connected issues concerning the epistemological and statistical significance of sharp or precise hypotheses in empirical science.

El presente trabajo se circunscribe al problema de la representación y la referencialidad de la imagen, mismo que, desde la filosofía de la ciencia ha cobrado nuevos matices en el contexto de la relación entre ciencia y arte. Así pues, en esta revisión se buscará establecer tres líneas de desarrollo: en primera instancia, se planteará el problema de la representación del objeto como un campo de interés común en los ámbitos de conocimiento, tanto en la ciencia como en el arte. (...) Luego, en un segundo momento, se abordará el problema filosófico implicado en la referencialidad de la imagen, a partir de las propuestas de Max Black y Rudolph Arnheim. Finalmente, para dar respuesta a la pregunta ¿bajo qué condiciones la imagen como representación establece un objeto de referencia?, se argumentará la función epistemológica de la imagen desde el punto de vista pragmático de la semiótica trascendental. En este sentido, en este trabajo se busca establecer un punto crítico a las posturas filosóficas, tanto de Black como de Arnheim, considerando que la pregunta acerca del objeto de referencia y la imagen están en relación con las condiciones de verdad que fundamentan un sistema de lenguaje. Por ello, a partir de la semiótica pragmática y la semiótica trascendental se postularán criterios diferentes al problema de la referencialidad de la imagen, y en esta dirección, se plantearán las condiciones pragmáticas de verdad que permiten justificar el conocimiento en la imagen derivado de las prácticas epistemológicas tanto en la ciencia como en el arte. In this paper, we provide an analysis of the concept of legal personality and discuss whether personality may be conferred on artificial intelligence systems (AIs). Legal personality will be presented as a doctrinal category that holds together bundles of rights and obligations; as a result, we first frame it as a node of inferential links between factual preconditions and legal effects. However, this inferentialist reading does not account for the ‘background reasons’ of legal personality, i.e., it does not explain why (...) we cluster different situations under this doctrinal category and how extra-legal information is integrated into it. We argue that one way to account for this background is to adopt a neoinstitutional perspective and to update the ontology of legal concepts with a further layer, the meta-institutional one. We finally argue that meta-institutional concepts can also support us in finding an equilibrium around the legal-policy choices that are involved in including (or not including) AIs among legal persons. Este artículo tiene el objetivo de explorar algunas funciones semióticas que constituyen el espacio urbano. Se revisarán algunas categorías y operaciones semióticas relevantes en la comprensión del espacio para que, desde ahí, se pueda explorar el sentido de la noción Centro Histórico como un concepto fundamental en la construcción del imaginario social en las ciudades de occidente.

Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply with (...) some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)
